Delivery Policy of Correos

 

The most recent full version of the Conditions, as published and updated on the dedicated page of the website www.correos.es relating to the territory in question, supersedes all previous versions and prevails over any other version. The Sender who assigns a Shipment to Correos accepts the Terms in effect at that time. Available Services may from time to time be modified or suspended by Correos. Such changes or suspensions will apply to Shipments assigned to Correos at a later date. Details regarding the Services currently offered are available at www.correos.es.

The following is a summary of the main points contained in the Correos Conditions of Carriage:

 

It will be made according to the method chosen for each product and shipment.

Delivery to a chosen office: (Paq Premium and Paq Estándar) will be delivered to the post office designated by the sender. In this case, the addressee will be notified of the arrival at the office by means of an arrival advice slip delivered to the home address. The recipient will be notified of the arrival at the office by SMS and/or e-mail. The list of offices available for delivery to the chosen office will be provided by Correos Marketing Service.

CORREOS reserves the right to refuse all shipments whose contents could be considered prohibited, or shipments whose carriage is subject to special requirements or provisions. CORREOS reserves the right to refuse, withhold, cancel, postpone or return to the Sender all shipments that cannot be transported, in accordance with the regulations in force. In the event that the Sender delivers a prohibited item to CORREOS, the Sender agrees to indemnify CORREOS for any damages and to reimburse the amount of penalties and any other expenses incurred by CORREOS.

The Customer agrees, in accordance with the Universal Postal Service, Users’ Rights and Postal Market Law, it’s implementing regulations and applicable International Postal Conventions, not to send prohibited items and dangerous goods through the Correos network.

The customer agrees to indemnify and hold Correos harmless from any loss or damage resulting from the sender’s failure to comply with the applicable regulations and the following warranties and representations: that the mailing is not subject to the prohibitions of the Universal Postal Service Law and its implementing regulations.

Prohibitions and restrictions of the IATA, ICAO and International Postal Conventions to ensure that the item is correctly identified and that the delivery note is correctly completed, that the item is correctly packed to ensure safe carriage by air and by road, with normal care and handling and that all obligations and formalities are set out in the Universal Postal Service Act and its implementing regulations.

Obligations and formalities set forth in the Universal Postal Service Law, its implementing regulations, the National Regulations for the Safe Transport of Dangerous Goods by Air and the Technical Instructions for the Transport of Dangerous Goods.

CORREOS points out that, in cases provided for by law, the competent authorities may open and inspect a shipment without prior notice to the sender.

In accordance with the National Civil Aviation Security Programme, the shipper accepts that its shipments may be subject to inspection, detention or other additional measures.

The customer warrants that the contents of his consignment are acceptable for carriage by CORREOS and that the consignment is correctly identified, addressed (including post code) and prepared for safe carriage with reasonable care in its handling, assuming directly the responsibilities, associated with its non-performance.

Similarly, it’s responsible for the correct and exact wording, in all documentation it must complete, of the data referring to the sender, the consignee, the contracted services and the characteristics of the shipment.

The admission of shipments shall take place at the admission points indicated and published by CORREOS.

The service will be provided nationwide, from Monday to Friday, excluding public holidays.

Neither Saturday nor 24 and 31 December will be counted in the calculation of delivery times. The calculation shall also not take into account days on which the following circumstances occur

– Delay caused by the customer’s failure to fulfil obligations.

– Specific days agreed upon in writing by the parties.

Shipments shall be delivered to the recipient’s address indicated by the sender, although not necessarily to the recipient himself, unless the extra service of “delivery only to the address” is provided.

In cases where the delivery cannot be completed due to weight, volume or the characteristics of the building where the delivery is to be made, the package will be delivered at the street entrance or at the CORREOS office of destination, with the agreement of the recipient.

CORREOS reserves the right to change the agreed times for deliveries or pick-ups according to its organisational requirements.

The digital signature of the addressee, as well as its reproduction, is sufficient proof of delivery and the parties acknowledge that it is just as valuable as a traditional signature on paper.

The same applies to the addressee’s identification stamp.

Shipments must be accompanied by the documentation established for each type of service. This documentation is available to the sender for automatic generation through the computer application provided by CORREOS (GECO), Correos Online (at www.Correos.es) or any other application that may be made available by CORREOS.

Information on the status of shipments will be available to the customer via Correos Online (www.Correos.es), automatic feedback information from file and by their Commercial Services contact person. They will also be able to make consultations by telephone on +34 902 197 197 .

This information will consist of the date and time of the status of the shipment: accepted, attempted delivery, delivered and returned.

If necessary, the reasons for return or non-delivery and the measures taken shall be indicated.

CORREOS reserves the right to renounce the transport of the goods or to suspend it if already started, in case of non compliance by the Sender or the Consignee with the rules established in these terms and conditions and, in particular, with the provisions of the sections “Exclusions” and “Dangerous Goods”.

If CORREOS has the right to suspend the carriage for a reason provided for in these terms and conditions, it shall inform the Sender, who shall not be entitled to a refund of the price of the shipment.

You shall not be entitled to reimbursement of the transport costs paid.

In the event of impediment to transport or delivery, CORREOS may unload the goods immediately at the expense of the person entitled, assuming custody thereof, or it may deliver the goods to the sender.

It may also hand over the goods in storage to a third party or to the competent judicial body or to the Transport Arbitration Board, which shall have the effect of delivery.

If CORREOS has chosen to unload the goods, it may consider the respective shipment abandoned if, three months after the date on which it first attempted to deliver the goods, the goods have been handed over to a third party.

In this case, it may dispose of the goods by offering them for sale to cover the transport and storage costs generated up to that time.

If the market value of the goods is insignificant, it may destroy them and claim from the sender the full costs due for transport and storage. For all this, CORREOS may open and inspect the packages entrusted for transport. In this case, CORREOS shall be held harmless from any claims by third parties asserting rights to the goods.

With regard to the carrier’s liability, rights of claim and payment of compensation, the rules established by the Law on the Contract of Carriage of Goods by Land and applicable international conventions shall apply.

The liability of CORREOS is strictly limited to direct losses, excluding all other types of loss or damage (such as, but not limited to, loss of profits, loss of interest and future business, etc.).

In accordance with the provisions of Law 15/2009 of 11 November on the contract of carriage of goods by road, compensation for loss or damage may not exceed one third of the public revenue index (IP). It may not exceed the price of transport.

The recipient must express his reservations in writing, describing in general terms the loss or damage at the time of delivery. In the case of non-obvious damage or loss, reservations must be made in writing within seven calendar days after delivery. Delay can only give rise to compensation if the written reservations have been sent to the carrier within twenty-one days from the day after delivery of the goods to the consignee. In the absence of proof, the goods shall be presumed to have been delivered in the condition described in the consignment note.

The Customer may extend the limit of liability by taking out one of the following options:

“Standard Insurance” option, with a maximum coverage of EUR 15/kg of damaged weight and up to a maximum of EUR 500/shipping.

For the purposes of this cover, the Customer shall pay the amount specified in Schedule 91 of the Main Contract, unless expressly waived in the Schedule.

Declared Value Parcel Service Option. The shipper may declare on the consignment note the value of the goods in the section intended for that purpose, subject to a maximum compensation limit. For this purpose, with a maximum indemnifiable limit of up to €6,000 per shipment. For the purposes of the above coverage and as a supplement to the freight, the customer shall pay the percentage indicated in the tariffs and agreed in the contract of the declared value, which shall always be at the time of collection of the goods to be transported.

Depending on the product chosen, the customer may contract a number of extra services, which must be indicated in the pre-registration.

The price will be agreed between the customer and Correos and, if not, it will be the one stipulated in Correos’ public tariffs.

The extra services available are:
